“Agreement” or “Terms” refers to these Terms and Conditions of Use and any subsequent modifications. “Subscriber” refers to any person who purchases or uses a subscription to Educharya.com. “Website” or “Site” refers to the website maintained on the World Wide Web by EDUCHARYA, available at http://www.educharya.com

Modification in Terms and conditions.

EDUCHARYA reserves the right to modify these Terms and Conditions at any time. Notice can be given through e-mail, posting on the Site or any other means by which a Subscriber may obtain notice. The Subscriber agrees to check the Site periodically for changes to these Terms. Using the Site after changes have been made, shall be deemed acceptance of those changed terms and/or conditions.

Modifications to the website educharya.com may make improvements and/or changes in the products and/or programmes described in the Educharya's website without liability. Educharya.com reserves the right in the sole discretion to review, improve, modify or discontinue temporarily or permanently any content or information on the site with or without notice to the user. User agrees that Educharya .com shall not be liable to user or any third party for any modification or discontinuance of the site.

Annual Subscription

The Annual Subscription plan includes access to educharya.com that the Subscriber has subscribed for. The Subscription fees are non-refundable. EDUCHARYA may increase subscription fees for a subscription period at any time and for any reason, provided, however, all the subscriptions confirmed vide the Purchase Order before such date of revision of prices, shall be honoured by EDUCHARYA at the original agreed price.


With each subscription, EDUCHARYA E-learning Portal hereby grants each Subscriber a non-transferable license (ID and password) to access the content and information available on the Website according to the provisions contained herein, and subject to the payment of the applicable subscription fees and adherence to these Terms. Each Subscriber shall be authorized to access the website from any Internet connection.


EDUCHARYA warrants that the Animations and Videos are of good quality and without any defects, and it shall be their duty to maintain such standard throughout the term of the subscription. The Subscriber acknowledges and agrees that temporary interruptions of online training services may occur; however, EDUCHARYA shall exercise reasonable care to prevent or minimize such interruptions. Although EDUCHARYA Education Portal has attempted to provide accurate information and course ware on the site, the information contained herein may contain errors or omissions. Educharya.com makes no guarantee or warranty, express or implied, as to the reliability, accuracy, timeliness or completeness of that information and assumes no responsibility for any errors therein. All such information is provided "as is" and with specific disclaimer of any warranties or merchantability, fitness for a particular purpose, title or non-infringement. Educharya.com makes no warranties or representations of any kind that the services provided by its website or any linked site will be uninterrupted, error free or that the sites or the servers that hosts the site are free from viruses or other forms of harmful computer code. All Streams Such as CBSE ICSE and State Board training materials provided by EDUCHARYA Education Portal, including the Animations, videos, Texts exercise files, are the sole property of EDUCHARYA, protected by the Copyright Laws of India and the laws of other countries where courses shall be made available, governing the making of copies or other reproductions of copyrighted material thereof. This excludes the material that have the written or verbal consent of its legal owner. Each course is designed for an authorized, single Subscriber only. Any copy, distribution or disclosure of the contents without the written authorization of EDUCHARYA is strictly prohibited. The Subscriber may not use the materials for any purpose other than for their own education purposes and no additional license is implied. The Subscriber may not copy, transfer, lease, assign, make available for timesharing or sublicense EDUCHARYA copyrighted materials, in whole or in part, nor modify, reproduce nor distribute the materials electronically or otherwise. No right, title or interest to any trademarks, service marks or trade names of EDUCHARYA is hereby granted. Unauthorized or improper use of such materials may result in civil and criminal penalties.


The Subscriber agrees to defend, indemnify and otherwise hold harmless, EDUCHARYA and its officers, directors, agents, employees, shareholders, successors and assigns from and against any cause of action or claim, including court costs, expenses and attorney fees, related to or arising from Subscriber’s Prohibited Conduct or other improper or illegal use of the Site, or breach of these Terms.

Termination of Agreement

EDUCHARYA may terminate this Agreement at any time and at its sole and absolute discretion. EDUCHARYA may also terminate Access to the Website or cancel subscriptions without notice if it believes, in its sole judgment, that you have breached or may breach any term or condition of this Agreement, or engaged in conduct that EDUCHARYA deems inappropriate. On termination, the terms and conditions stated herein, in addition to the right to use the Website and other materials provided thereof shall stand terminated with immediate effect. However, the payment obligations of the Subscriber shall survive such termination. On the acceptance of this Agreement, the Subscriber shall not be permitted to cancel the issue of subscription of the Website. On such undue cancellation, EDUCHARYA shall reserve the right to forfeit the amount of consideration paid by the Subscriber in pursuance of this Agreement.

Dispute Resolution

All disputes and differences of whatsoever nature, whether existing or which shall at any time arise between the parties hereto touching or concerning the Agreement, meaning, operation or effect thereof or to the rights and liabilities of the parties or arising out of or in relation thereto whether during or after completion of the contract or whether before after determination, foreclosure, termination or breach of the Agreement (other than those in respect of which the decision of any person is, by the Agreement, expressed to be final and binding) shall, after written notice by either party to the Agreement to the other of them, be referred to the arbitration of a sole arbitrator to be agreed upon between the parties. The parties hereby submit all their disputes arising out of or in connection with this Agreement to the exclusive jurisdiction of the Courts of Pune.
